Board Bros LLC ("Board Bros," "we," "us," or "our") operates the website boardbrosconcessions.com (the "Site") and provides watercraft rental and concession services at Shadow Cliffs Regional Recreation Area and other locations. This Privacy Policy explains how we collect, use, and protect information when you visit our Site or interact with us online.

  • Contact information (name, email, phone number) submitted through contact forms or booking inquiries

  • Messages or questions you send us

Information collected automatically:

  • Standard website usage data such as IP address, browser type, device information, and pages visited, collected through our website platform (Wix Analytics) and Google Analytics

  • Cookies and similar tracking technologies (see Section 4)

Payment information: Rental transactions and payments are processed through Square. Square may securely store your payment card on file to facilitate future or repeat transactions, in accordance with Square's own privacy policy and security standards. We do not directly store your full payment card details on our Site or systems.

Waiver and identification information: If you rent equipment or participate in an activity requiring a liability waiver, you will be asked to sign a waiver and provide a copy of your government-issued ID through our waiver platform, CleverWaiver. CleverWaiver stores your signature and ID copy on our behalf, in accordance with CleverWaiver's own privacy and security practices. This information is used to verify identity, enforce age and eligibility requirements, and maintain records of liability waivers as needed for our business and insurance purposes.

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and booking requests

  • Operate, maintain, and improve the Site

  • Communicate with you about your rental or reservation

  • Understand how visitors use our Site

  • Comply with legal obligations

We do not sell your personal information. We may share information with:

  • Service providers who help us operate the Site and business, including Wix (website hosting and analytics), Google (analytics), Square (payment processing and card-on-file storage), and CleverWaiver (waiver signature and ID storage)

  • Legal authorities if required by law, subpoena, or to protect our rights and safety

  • Successors in the event of a business transfer, merger, or sale of assets

Signed waivers and accompanying identification copies collected through CleverWaiver are retained permanently and are not deleted upon request. This is because these records serve as evidence of informed consent to assumption of risk and verified identity, and may be needed to establish, exercise, or defend against legal claims — including claims brought by minors, for whom the applicable statute of limitations may not begin until years after the rental occurred.

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to:

  • Know what personal information we have collected about you, and the categories of sources, purposes, and third parties involved

  • Access a copy of the personal information we hold about you

  • Correct inaccurate personal information

  • Delete personal information we have collected about you. This right does not apply to signed waivers and identification copies collected through CleverWaiver, which we retain permanently and do not delete upon request, as permitted under CCPA's exception for information necessary to comply with legal obligations and to establish, exercise, or defend against legal claims. For all other personal information (such as contact form submissions), we will honor deletion requests.

  • Opt out of the sale or sharing of personal information — we do not sell personal information, and we do not share it for cross-context behavioral advertising

  • Non-discrimination — we will not deny goods or services, charge different prices, or provide a different level of service because you exercised any of these rights

To exercise any of these rights, contact us using the information in Section 13. We may need to verify your identity before fulfilling a request.

9. Do Not Track and Third-Party Links

Our Site does not currently respond to browser "Do Not Track" signals. Our Site may contain links to third-party websites (including Square, CleverWaiver, and social media platforms). We are not responsible for the privacy practices of those third-party sites, and we encourage you to review their privacy policies separately.
